En la agricultura, la propiedad intelectual cumple un papel determinantes en la protección de insumos agrícolas, tales como semillas de variedades obtenidas por métodos convencionales o a través de la ingeniería genética, plantas transgénicas, alimentos, aparatos, maquinarias, productos animales, herbicidas y plaguicidas, entre otros. Pese a algunas protestas, la comercialización de productos biotecnológicos protegidos, mediante patentes se ha incrementado de una manera vertiginosa en el mundo, así como el desarrollo de plantas con resistencia a herbicidas, por lo que la propiedad intelectual tiene y tendrá un efecto positivo en la investigación y desarrollo agrícola
